I apologize for the omission of the documentation for this record. I will include it as I find it. However I believe the record is from the County of Albemarle in North Carolina. This record is important for at least two reasons. First it documents a time and place for Daniel and Mary. Second it shows again that all information must be questioned, especially what is not public record. The story that I've read about the following is that Mary dealt bought or sold a slave on a Sunday. As you can see that is not the case.
I have taken the liberty of eliminating the superscript abbreviations used. They are a little hard to read and a lot of trouble to keyboard.
Thomas Pendleton: by: Daniel Richardson his attorney: Comes to pros his informacon against Daniell Guthrie; and Saith that: Whereas In: & by an act: made by the Grand assembly: of this province between ye 21th. day of January: Anno Dni 1705/6 and the Eight day of March then next following Intitled an act Consearneing Servants and Slaves by which Said act, it was (interalia) Enacted in ye following or the like words (viz) and be it further enacted by the authority foresaid That whosever buy sell Trade or Trucke Borrow or lend to or with any Servant or Servants Slave or Slaves without the Lycense or Consent: of his or their; mastor or owner for any Comodity whatever Shall forfeit & pay: for every: Such offence Ten pounds to be recovered as aforesaid as in & by the Said act relacon being thereunto had Doth & may more fully appear: Notwith standing which said Daniel Guthrie and Mary his wife of ye precinct aforsaid & within the Jurisdiction of this Court: & Especially she The Said Mary: the aforsaid act nothing or regarding but ye Same & the Authority thereof altogether Dispiseing and as well in Comtempt thereof as Contrary to ye purport: True Intent & meaneing thereof: She ye Said Mary Did in ye month: of June last past on a Sabath Day Deale Trucke and Trade to & with a negro: woman to him the said Thomas pendleton belongen Comonly Called or known by the name of Jenny: of of her Did Take and receive Two: Sticks of whalebone to ye value of Two: Shills in Consideracon whereof She the Said negro woman Did or was to have & receive of her that Said Mary Two: fouls or Dunghill Cockes without ye Leave Lycence Consent or knowledge of him the Said Thomas pendleton and as well to the Great Damage of him ye Said Thomas pendleton as Contrary to ye True Designe of ye aforsaid act whereupon & c and the Said Defendent by: Thomas Snoden and Edward Bonwicke his attorney Comes to ye Plts Informacon: Doth: Demurr; which being Joyned by the plaintiff and Argued on both sides: and the Court have Considered ye Severall Causes offerd by the Defendant it is ye oppinion of this Court that ye Said Demurrer ought to be overruled and it is hereby over Ruled and thereupon the Defendant by his attorneys aforsaid moved for an arrest of Judgement till ye next General Court and it is Granted.
As you can see Mary traded two chickens to the negro Jenny for two sticks of whalebone. Also she got off.
