4.   Discuss, consider and take action on the election of the Chairman and the Vice Chairman of the Board

      Of Carter County Commissioners for 2010.

 

5.   Discuss, consider and take action on the minutes of the regular meeting held on December 28, 2009.

 

5.   Discuss, consider and take action on opening 6 month bids for radios.

 

7.   Discuss, consider and take action on opening bids for a used truck for District #3.

 

8.   Discuss, consider and take action on an update of the County EOP to reflect current contact information

      And add the commissioners’ district map.

 

9.   Discuss, consider and take action on Project #BRF-NBIL (222) CO, JP NO 26848(05) Walnut Bayou

       in the amount of $9,942.08 for geotechnical services.

 

10. Discuss, consider and take action on entering into Executive Session concerning:

 

            Shawnda Maxwell v. Carter County, a political subdivision by being sued in the name of the

            Board of County Commissioners of Carter County, etal.  Case No. CIV-09-216-RAW.

            On the advice of legal counsel, possible Executive Session for the purpose of confidential

            Communications between the Board of County Commissioners of the County of Carter and

            Its attorney concerning the federal lawsuit previously referenced.  Legal counsel advises that

            Public disclosure of these confidential communications would likely seriously impair the

            Ability of the Board and its attorney to properly process and defend this litigation.  As such,

            The communications in the Executive Session are confidential.

11. Discuss, consider and take action to return to regular session and vote to temporarily recess the

       Executive Session.  On the advice of legal counsel, the Executive Session will reconvene at the United

       States Federal Executive Session will re-convene at the United States Federal Courthouse, Eastern

       District, 101 N. 5th Street, Muskogee, Oklahoma, for purposes of a court ordered mandatory

       Settlement Conference on January 11, 2010 in the litigation matter of:

 

            Shawnda Maxwell v. Carter County, a political subdivision by being sued in the name of the

            Board of County Commissioners of Carter County, etal.
